About the Journal
Revista de Derecho is a scientific publication of the Facultad de Derecho of the Universidad de Montevideo, which is published every six months in June and December of each year, in continuous publication mode. It is aimed at a specialised public and its objective is to contribute to the development of legal knowledge.
Since 2002 it has been published regularly, including the following sections: message from the Dean or the Director, doctrinal articles, lectures and master classes, annotated jurisprudence, information from the Faculty, Masters theses, student monographs, and notes from books and journals.
The texts published in the Revista de Derecho are always original and unpublished. The journal accepts scientific contributions from specialists from various national and foreign academic institutions, which are submitted to peer review, under the double-blind refereeing system. The texts are published in Spanish and English.
Publication frequency:
Biannual, first issue: January-June and second issue: July-December, both in continuous publication mode. Texts are published immediately after approval and layout.
Sources of funding:
This journal is published by the Facultad de derecho of the Universidad de Montevideo. The journal is funded by the University of Montevideo and does not charge any fee for submitting texts to the review process, evaluating or publishing articles in the journal.
Charges for processing articles:
Revista de Derecho, does not have charges or fees for the processing of articles (Article Processing Charge [APC]) sent by the authors. There is no fee paid for the presentation of the texts to the evaluation process either.
Open Access Policy:
The Revista de Derecho provides immediate and free access to all the contents of this electronic edition and permitting any user to read, download, copy, distribute, print, search, or link to the full texts of articles, crawl them for indexing, pass them as data to software, or use them for any other lawful purpose, under a Creative Commons Atribución 4.0 Internacional (CC BY 4.0).
The full text of all contents is available free of charge and open access without delay. No embargo period. Users are not required to register to read the content.
Preservation policy:
In order to guarantee the preservation of its content in open access over time, the journal carries out the following procedures:
1) PKP has developed the PKP Preservation Network (PKP PN) to digitally preserve OJS journals through the LOCKSS programme, which offers perpetual access without interruption and preservation of the authentic original version of the content. The journal Revista de derecho is part of the programme and is hosted on a preservation node, which can be verified at The Keepers.
2) Periodically, the software (Open Journal System) and its contents are backed up on the servers of the Universidad de Montevideo.
3) The journal uses a DOI in each article uploaded for the identification and unequivocal location of the document.
4) Articles are deposited in pdf and html formats, both of which are widely used.
5) All the content of the journal is preserved in the cloud.

The authors who publish in this journal accept the following terms:
The authors retain the copyright and grant the journal the right of first publication of the work under a Creative Commons Atribución 4.0 Internacional (CC BY 4.0) license, which allows others to share the work with an acknowledgment of authorship and an acknowledgment of their initial publication in this journal.
Authors are allowed and encouraged to publish their work online (in repositories or on their website) after the presentation of this issue of Revista de Derecho, as this can generate productive exchanges, as well as a higher citation of the published work (see “The Effect of Open Access”).
Commitment to the editor and copyright:
Only original content that is not committed to another publication and whose author(s) are in full possession of publishing rights will be published. The submission of the originals to the editor entails that the author or the authors of the collaborations give to Revista de Derecho the reproduction rights of the admitted texts. In turn, cases of co-authorship must be expressly stated, as well as cases in which the author received collaborations, suggestions or comments from third parties.
Declaration of Originality:
The authors must accept and sign the Declaration of originality and submit it together with the main text.
Ethical codes and conflicts of interest:
Revista de Derecho adheres to the international standards and codes of ethics established by the Committee on Publication Ethics, COPE (Guidelines on Good Publication Practice and Code of Conduct). Authors, editors, reviewers and editorial staff agree to read and accept the present Code of Ethics of the journal.
The authors acknowledge all sources of funding used in their work and expressly indicate, when appropriate, the funding agency and any other commercial, financial or private link with persons or institutions that may have interests with the proposed work.
Plagiarism Detection:
The identification of plagiarism in the text is a reason for rejection by Revista de Derecho. If plagiarism is detected, the author is informed of the reason for the rejection of his contribution, with the evidence of plagiarism clearly stated.

Policy on the use of artificial intelligence:
General principles:
In accordance with COPE guidelines:
AI tools cannot meet the criteria for authorship, as they cannot take responsibility for scientific content.
They cannot manage conflicts of interest, copyright, or make ethical decisions on their own.
Their use must be acknowledged, but not attributed as authorship.
Use of AI by authors:
Declaration of use:
Authors must explicitly declare the use of any AI tools in the writing or analysis of their manuscripts. The software used, the functions applied, and the sections of the manuscript where it has been used must be specified.
Responsibility for originality:
The author is responsible for the originality of AI-generated or AI-assisted content. The generated material must not infringe on the rights of third parties or plagiarise existing content.
Review of AI-assisted content:
Authors are responsible for carefully reviewing and verifying any AI-generated content to avoid bias, errors, or inaccuracies.
The use of AI to create or alter images in submitted works is not recommended to avoid ethical and legal issues.
Bibliographic references generated with the help of an artificial intelligence tool must be verified manually to avoid errors and false citations.
Use of AI in peer review:
The texts reviewed are original, unpublished and subject to copyright and must therefore be treated confidentially. Reviewers must not use artificial intelligence tools to evaluate the content of the work.
Ethics in the use of AI:
The use of AI must not, under any circumstances, lead to data manipulation, plagiarism, or intellectual property violations. Any misuse of AI, whether intentional or not, will be treated in accordance with COPE policies.
Privacy Statement:
The names and e-mail addresses entered in this journal will be used exclusively for the purposes stated by the journal and will not be available for any other purpose or other person.
Use of Interoperability Protocols:
The journal uses the OAI-PMH protocol (Open Archives Initiative - Protocol for Metadata Harvesting) for the exchange of metadata on the Internet. Address OAI-PMH: http://revistas.um.edu.uy/index.php/revistaderecho/oai. The metadata used is encoded in Dublin Core.
